DOJ Could Recuse SCOTUS Judges

(ImpactHeadlines.com) – Representative Jamie Raskin (D-MD), a top Democrat lawmaker, suggested during an interview that the United States Department of Justice can force the recusal of Supreme Court justices that he disagrees with.

Raskin specifically called out conservative justices Clarence Thomas and Samuel Alito. Both have faced condemnation from far-left lawmakers after saying they are unable to rule on cases and matters related to January 6th objectively. Thomas’ wife made headlines for attending former president Donald Trump’s rally ahead of the capitol riot. The far-left has also criticized Thomas for supposedly “downplaying” the events that day.

Raskin then suggested that while it would be “nice” if Thomas and Alito recused themselves, there is a “far more effective course.” Raskin claimed that Merrick Garland, President Joe Biden’s attorney general, could collaborate with the DOJ to coerce the remaining seven SCOTUS justices to demand that Thomas and Alito recuse themselves. He said they could use current federal statutes that relate to judicial disqualifications.

He also said the recusal statute must come from Congress, where Republicans currently maintain a slight majority. Still, he accused SCOTUS of breaking constitutional separation of powers laws. He said the other seven justices, most of whom are conservatives, have both a moral and legal obligation to demand recusal.

Raskin gained recognition for serving as one of the impeachment managers when Trump faced a Senate trial for supposedly inciting a riot and insurrection. Far-left lawmakers and pundits have repeatedly tried to tie Thomas and Alito to that event in an effort to disqualify them as SCOTUS justices. Additionally, Democrats have also heavily attacked Alito recently over a 2021 dispute between him and some of his liberal neighbors after he allegedly hung an upside-down US flag.

He has also focused heavily on the work of Ginni Thomas, a conservative activist and wife of Justice Thomas. She allegedly promoted the idea that the 2020 election was stolen from Trump, which impacts her husband’s ability to judge impartially, according to Raskin.
